Synopsis:

Basic information on consumer protection in general, interpretation of legislation from general to special, incl. consumer protection in financial markets. Emphasizing the importance of codes of ethics as one of the preventive tools for consumer protection and the cultivation of the consumer market.

Requirements:

The course will end with an exam in the form of a contact test, or. through the tools of the information system, if there is no possibility of a contact method of completing the course.

Syllabus of lectures:

1. Characteristics of consumer protection, legislation, sources of law in the Czech Republic and the EU, definition of basic concepts in consumer protection, regulation and supervision in the field of consumer protection in general and with a focus on financial markets.

2. Characteristics of the Consumer Protection Act and a more detailed interpretation of selected provisions.

3. Consumer protection in contracts concluded outside the normal place of business.

4. Consumer protection in distance contracts.

5. Consumer protection in selected areas of the financial market - payment services, collective investment, consumer loans.

6. Out-of-court dispute resolution - general approaches, characteristics.

7. Out-of-court settlement of disputes - proceedings before a financial arbitrator (competence, initiation of proceedings, decisions, remedies).

8. Out-of-court settlement of disputes - arbitration proceedings (arbitration clauses, arbitrators and his position, competence, initiation of proceedings, arbitration award).

9. Judicial settlement of disputes - the importance of courts and their position in resolving disputes in the field of financial and legal relations.

10. The role of the Ministry of Finance of the Czech Republic, the CNB and the CTIA in the area of ​​regulation, supervision and supervision of consumer disputes.

11. The importance of codes of ethics in consumer protection, especially in financial services.

12. Examples from practice in problems of consumer disputes.

13. Summary and evaluation of the course, emphasis on the basic principles of consumer protection, case study.

Syllabus of tutorials:
Study Objective:

The main goal of the course is to teach students to protect consumers not only in the financial markets from unfair practices of sellers and financial institutions, and to be able to recognize such behavior. Another aim of the course will be to acquaint students with the legislation of consumer protection not only in the Czech legal system, but also in the European context with a focus on the possibility of advisory activities to end consumers, incl. possibilities for out-of-court dispute resolution.
