Synopsis:

A complex course dedicated to interdisciplinary problems - the legal aspects of electronic communications (information and communications systems), as well as media from the viewpoint of European and national law. It analyses the areas of informatics, electronic communications, information society services, copyright and general intellectual property rights, the protection of identity, introduction to software law and the Internet as a global communication and information system.

Requirements:

For successful completion of the course, presentation of the results of individual work assigned by the lecturer to other fellow-students is required, together with an explanation of the approach used. 100% attendance of all seminars is obligatory. Final examinations are either in the form of a test or oral examination after a credit has been given.

Syllabus of lectures:

1. Introduction to the course. Making law. Legal branches. The Constitution and the constitution order of the Czech Republic. European law. Legislative power.

2. Informatics. Information and informatics. Information society. Legal regulation of information. Information systems. State administration of information and communication systems.

3. Communications. Information and communication systems, electronic communications, information society services.

4. Law of electronic communications. Legal framework of telecommunications prior to 2000. Telecommunications Act and provisions in the execution of the act. Electronic Communications Act and provisions in the execution of the act.

5. Czech Telecommunications Office. Relevant market analyses and legal instruments related to the Electronic Communications Act.

6. Information society services. The Act on certain information society services.

7. Broadcasting law. Radio and TV Operations Act. Czech TV and Czech Radio Acts. Conditional access and its legal protection. Protection of content.

8. Audiovisual media services.

9. Intangible goods, intellectual property, copyright.

10. Protection of content. Protection of intellectual property in information technologies. Legal protection of software.

11. Protection of identity. The system of the protection of human rights and personal liberties. Personal data processing and the protection of personal data. Protection of Personal Data Act. Constitutional principles of the protection of privacy and personal data.

12. Protection of competition in ICT. Protection of Economic Competition Act.

13. The Internet and the law. Subjects in internet law. Civil law obligations in connection with the Internet. Legal aspects of the Internet. Legal forces and organisation of the Internet, domain names, registered names. Contracts with providers, author protection, identity protection, telecommunication confidentiality. The Internet and administrative and penal law. Torts in connection with the Internet. Administrative law acts on-line. Criminal activities on the Internet, etc.

14. Digital economy. Introduction to software law. Conclusion.

1. Informatics and information systems in private and public law. Law relating to informatics. The Constitution of the Czech Republic. The Charter of Fundamental Rights and Freedoms.

2. State power and its division. Legislation and legislative rules.

3. Information systems. Documentation, databases, electronic documents and electronic signatures. Legal validity of IT-processed documents.

4. Protection of the individual and personal data.

5. ICT in the state administration.

6. Electronic documents and electronic signatures. Protection of personal data.

7. Relevant markets of electronic communications and their analyses.

8. Broadcasting. Information society services. Radio and TV operation law and act.

9. The Internet - contracts with providers, author protection, identity protection, criminal activities on the Internet.

10. Protection of intellectual property in information technologies.

11. Copyright. Software.

12. Trade Code in ICT - contracts, responsibility, legal and contractual guarantees.

13. Competition law in ICT.

14. Conclusion of the course.
